Patient holding their hip because of chronic pain

Chronic pain kept Texans out of the state’s medical cannabis program for a decade. That ended on 1 September 2025, when House Bill 46 made chronic pain a qualifying condition in its own right. You no longer need a cancer diagnosis or a seizure disorder to be eligible.

Dr. Sina Najafi offers convenient video evaluations for chronic pain patients anywhere in Texas to decide if you are eligible for a medical marijuana prescription. The annual fee is $150, and if he determines that you do not qualify, the fee is fully refunded. Refill requests are included at no additional cost.

Chronic Pain for Medical Marijuana Eligibility: What TCUP Requires

The Texas Compassionate Use Program does not work from a checklist you fill in yourself. A physician registered with the state decides whether low-THC cannabis is clinically appropriate for you, then enters a prescription. Eligibility rests on that clinical judgment, not on naming a condition.

Two things have to be true. Your pain must meet the statutory definition, and a CURT-registered physician must agree that a trial of medical cannabis is reasonable given your diagnosis and history.

The 90-Day Rule: How HB 46 Changed the Compassionate Use Program

HB 46 wrote a specific test into the Compassionate Use Program. Qualifying chronic pain is continuous or intermittent severe pain lasting more than 90 days, measured from when the pain began rather than from when you first sought treatment.

HB 46 removed the old prerequisite as well. Earlier drafts of the law would have required patients to try and fail opioid therapy first. The final bill did not, so you can be eligible without ever having filled an opioid prescription.

Chronic Pain as a Qualifying Condition Alongside Cancer, PTSD and Epilepsy

Chronic pain now sits beside the conditions Texas has recognised for years. Epilepsy came first in 2015. Cancer, multiple sclerosis, spasticity and incurable neurodegenerative disease followed, then PTSD in 2021.

HB 46 added five more: chronic pain, inflammatory bowel disease, traumatic brain injury, Crohn’s disease, and patients receiving palliative care.

You do not need to figure out eligibility alone. A registered physician can assess it

Which Types of Chronic Pain May Respond to Medical Cannabis Treatment

Pain is not one condition. It arrives through inflammation, through damaged nerves, through worn joints, and each mechanism responds differently. Below are the presentations we evaluate most often since HB 46 took effect.

Note: Medical cannabis manages symptoms. It does not repair a disc, reverse arthritis, or cure the condition underneath.

Medical Marijuana for Chronic Back Pain and Degenerative Disc Disease

Persistent lumbar pain is the single most common reason Texans ask about medical marijuana for chronic back pain. Degenerative disc disease, failed back surgery and facet joint pain all produce similar patterns: stiffness on waking, pain that worsens through the day, and poor sleep.

Neuropathy and Nerve Damage: Burning, Numbness and Shooting Pain

Neuropathic pain behaves unlike worn-joint pain. Patients describe burning, electric shocks, and numbness in the feet or hands. Diabetic and chemotherapy-induced nerve damage and neuropathic pain are the presentations we see most, and neuropathy is separately a qualifying condition.

Fibromyalgia and Widespread Musculoskeletal Pain

Fibromyalgia produces pain across the body rather than at one site, usually with exhaustion, disrupted sleep and cognitive fog. Bad spells can follow stress or poor rest. Because no imaging confirms it, patients often arrive after years of being told nothing is wrong.

Arthritis, Osteoarthritis and Chronic Joint Pain

Arthritis wears cartilage down and leaves bone loading bone. Joint pain follows. Hands, knees and hips take it worse, with inflammation driving much of the ache. Some patients report that an anti-inflammatory cannabinoid regimen takes the edge off stiffness.

Sciatica, Spasticity and Pain From Cancer Treatment

Medical marijuana may help ease nerve pain from sciatica, reduce muscle stiffness and spasms linked to spasticity, and support patients managing pain related to cancer treatment. For eligible patients, it may offer another option when conventional treatments provide limited relief.

Medical Cannabis for Chronic Pain: What THC and CBD Research Shows

The honest summary is that the evidence is real but uneven. Trials support cannabis most strongly for neuropathic pain and least strongly for undifferentiated chronic pain. The CDC states plainly that evidence is limited for most pain types and that more research is needed. Anyone promising you a cure is selling something.

What patients report and what trials measure do not always match. Many describe better sleep and a lower daily dose of other medication rather than a pain score that drops to zero. That is worth knowing before you start.

How the Endocannabinoid System and CB1 Receptors Modulate Pain

The endocannabinoid system regulates how the body processes a pain signal. CB1 receptors concentrate in the brain and spinal cord, along the pathways that carry a pain signal. Others sit in immune tissue, where they influence inflammation.

THC acts on both, which is why it has analgesic effects and psychoactive ones. CBD works differently, on ion channels and serotonin receptors rather than as a direct CB1 agonist, and produces anti-inflammatory effects without intoxication.

What the Trials Show About Medical Cannabis for Pain

Evidence quality varies by condition. A short summary of where it stands:

  1. Neuropathic pain: The strongest signal, with several randomised trials reporting reduced pain intensity.
  2. Fibromyalgia: Promising but thin, mostly small studies and patient-reported outcomes.
  3. Back pain: Mixed evidence from studies, with sleep and function improving more reliably than pain scores.
  4. Cancer-related pain: Best supported for nausea and appetite rather than the pain itself.

The research is still developing, and larger, longer-term trials are needed to understand who benefits most and by how much. Even so, many patients report meaningful improvements in sleep, daily function and overall quality of life, even when their pain does not disappear completely.

Medical Cannabis Compared With Opioids for Long-Term Pain

Opioids can be effective for severe pain, but long-term use may bring risks such as tolerance, dependence and overdose. Medical cannabis offers a different approach and may help some patients manage pain, sleep and daily function with fewer serious risks. Some patients also use cannabis alongside their existing treatment to reduce reliance on opioids. Any medication changes should be discussed with your prescribing physician.

For some patients, medical cannabis provides an alternate way to manage long-term pain

Choosing the Best Medical Cannabis for Chronic Pain: Forms, Ratios and Dosing

There is no single best medical cannabis for chronic pain. The right product is the one titrated to your symptoms and your tolerance. A patient who needs to work through the afternoon and a patient who cannot sleep need different formulations, and both are available under TCUP.

Finding Your THC to CBD Ratio With a Prescribing Physician

Texas prescriptions are written as a THC to CBD ratio and a dose. A CBD-dominant ratio suits daytime use and inflammation. Raising the THC share tends to help sleep and severe breakthrough pain, at the cost of more psychoactive effect.

Titration is the whole method. Start low, hold the dose for several days, adjust once you know what it does. Dr. Najafi stays reachable through that process, because the first prescription is rarely the final one.

Tinctures, Lozenges, Patches and Inhalers From a Licensed Texas Dispensary

You fill your prescription at a licensed Texas dispensary. Zen Cannabis Clinic is not a dispensary and does not sell products. Available forms include:

  • Tinctures and oils, which allow fine dose control
  • Lozenges for a longer, slower effect
  • Transdermal patches for localised joint pain
  • Inhalers, authorised by HB 46’s approval of inhaled products, for faster onset

Prescription products are lab-tested and their cannabinoid content is verified. Over-the-counter delta-8 sold at a smoke shop is neither.

In Texas, a Medical Marijuana Card for Chronic Pain Means CURT Registration

Texas does not issue a physical medical marijuana card. Instead, your doctor registers your prescription in CURT, the state’s online system. When you visit a dispensary, staff confirm your registration electronically using your photo ID. Zen Cannabis Clinic can also provide a free verification letter if needed.

Your Telemedicine Evaluation and Same-Day Prescription in the CURT Registry

Zen Cannabis Clinic runs the evaluation as a video appointment, from home, statewide. There is no waiting room and no office visit. Bring what you have: a diagnosis, medical records, an imaging report, a medication list. Documentation helps, but its absence is not automatically disqualifying.

Zen Cannabis Clinic reaches patients in Dallas, Houston and Austin as easily as a rural county with no certifying physician within two hours.

What the $150 Flat Fee Covers: Refills, Re-Certification and Verification Letters

One flat annual fee of $150, reduced from $200, with nothing charged monthly. Refill requests are free, verification letters are free, and there is no charge for the follow-up questions that arise once you start.

If Dr. Najafi finds no qualifying condition, you get a full refund. Re-certification comes around once a year, since a Texas prescription runs for twelve months.

No physical card means one less step between approval and accessing your prescription

Why Chronic Pain Patients Choose Zen Cannabis Clinic

Most certification clinics rotate you through whichever provider is on shift. You describe your pain to a stranger, get a prescription, and have nobody to call when the dose is wrong. That is the gap our practice was built to close.

FAQs: Medical Marijuana for Chronic Pain in Texas

Is medical marijuana legal in Texas for chronic pain?

Yes, with a prescription. Chapter 487 of the Texas Health and Safety Code authorises registered physicians to prescribe low-THC cannabis, and HB 46 added chronic pain to the eligible conditions from 1 September 2025. Buying cannabis without a prescription remains illegal in Texas.

Can you get medical marijuana for chronic pain without trying opioids first?

Yes. The final version of HB 46 contains no requirement to have tried opioids, so a patient who has deliberately avoided them can still qualify. Debilitating pain lasting more than 90 days is the test.

Do I need medical records to qualify for chronic pain?

Records help and are not strictly required. A physician needs enough clinical information to justify the prescription, so bring a diagnosis, medical history, imaging or a specialist letter if you have them. If you have none, Dr. Najafi will tell you during the evaluation what to obtain.
